France Published a new decree to PFAS!

On December 30, 2025, France officially issued Decree No. 2025-1376 through the Official Journal (JORF No. 0305). This decree aims to supplement and implement the Regulation No. 2025-188 issued on February 28, 2025, and further clarifies the specific limit requirements and exemption scope for PFAS. According to the new regulation, starting from January 1, 2026, PFAS will be restricted in cosmetics, Ski waxes, clothing textiles, footwear, waterproofing agents of clothing textiles and footwear; starting from January 1, 2030, the restriction scope will be extended to all textiles.

The new decree will come into effect on January 1, 2026, and a 12-month inventory transition period has been set. For products manufactured before January 1, 2026, they are allowed to continue to be sold or exported in the French market within the following 12 months.

The specific control requirements are as follows:

Exemption Scope:

1.Textile clothing products and footwear as personal protective equipment (PPE) covered by the EU PPE Regulation (EU) 2016/425, or as personal protective equipment (PPE) and combat equipment intended for the armed forces, internal security forces, and civil security forces.

2.Waterproofing agents intended for the re-waterproofing of textile clothing products and footwear referred to in Point 1.

3.Clothing textiles and footwear incorporating at least 20% recycled material from post-consumer waste (PCR), provided that the presence of PFAS in the finished product is limited to the fraction of recycled material, and that the amount of residual PFAS permissible in the finished product is proportional to the proportion of recycled material incorporated.

4.Technical textiles for industrial use.

5.Where there is no alternative to the use of PFAS, the textiles in:

a. Personal protective equipment (PPE) covered by EU PPE Regulation (EU) 2016/425.

b. Personal protective equipment (PPE) for the armed forces, internal security forces, and civil protection forces.

c. Equipment used in combat systems, as well as equipment intended for operations under nuclear, radiological, biological, and chemical threats.

d. Sanitary textiles intended for medical use, including certain products used for medical care.
